Terms and Conditions

1. What Evolve Is
Evolve is a digital membership giving you access to online content, teachings, community spaces, and resources hosted within our membership platform. Membership content is for personal, non-commercial use.
Evolve is educational and developmental in nature. It is not therapy, counseling, medical treatment, financial advice, or legal advice, and it is not a substitute for professional services in those fields. You are solely responsible for your own decisions, choices, and outcomes arising from your use of the Membership.
2. Payment Processing and Merchant of Record
All purchases made through this website are processed by our payment provider, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns and billing questions related to your purchase. Paddle collects your payment information directly and issues your order receipt and any applicable tax invoice.
3. Membership Pricing, and Billing
Evolve is offered as a recurring subscription, you will be told clearly at checkout that you are entering into a recurring payment, the billing frequency, and the price per billing cycle, before you complete your purchase. Prices may be adjusted for future billing cycles or new members; we will provide reasonable notice of any price change affecting an active subscription.
4. Cancellation and Returns
Your right to cancel your purchase, and our Refund Policy, are set out in our separate Return Policy, which forms part of these Terms. You must actively accept the Return Policy, together with these Terms, before completing your purchase.
5. Cancelling a Recurring Membership
If your Membership is a recurring subscription, you may cancel future billing at any time before your next renewal date by logging into your account and selecting "Cancel Membership" or emailing us at info@lividevi.com. Cancellation stops future charges; it does not entitle you to a refund for the current billing period already paid, except as described in our Return Policy.
6. Access, Suspension, and Termination
Your access to Evolve is personal to you and may not be shared, resold, or transferred. We reserve the right to suspend or terminate your access, without refund, if you share your login credentials, redistribute membership content, or engage in abusive or disruptive conduct toward us or other members.
7. Intellectual Property
All content within Evolve, including teachings, recordings, written materials, and community discussions curated by us, is the intellectual property of Livia Devi and is licensed to you for personal use only during your active membership. You may not reproduce, distribute, resell, or publicly share this content.
8. Community Guidelines and Confidentiality
Evolve may include community spaces where members share personal experiences. All members are expected to treat what others share with discretion and respect, and not to repost or disclose it outside the community.
9. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under Irish law. Subject to that, to the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential loss arising from your use of Evolve.

11. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland, without prejudice to any mandatory consumer protections entitling you to bring proceedings in your own country of residence.
12. Changes to These Terms
We may update these Terms from time to time; continued use of Evolve after changes are posted constitutes acceptance of the revised Terms.

Privacy Policy

1. Who We Are
Livia Devi is the data controller responsible for your personal data in connection with Evolve. Contact us at info@lividevi.com with any questions.
2. What Personal Data We Collect
- Identity and contact data: name, email address, and any details you provide when creating your membership account.
- Payment and order data: your purchase is processed by our payment provider, Paddle.com, who acts as Merchant of Record for the transaction. We receive confirmation of your order, membership tier, and billing status from Paddle, but we do not receive or store your full card details.
- Membership and platform data: your activity within the membership platform, such as content accessed, community posts, and progress within the program.
- Technical data: IP address, browser type, device information, and cookies collected through our website and membership platform.
- Marketing preferences: your subscription status and preferences for our newsletter or promotional communications.
3. How We Use Your Data
We use your personal data to provide and administer your Evolve membership, manage your account and access permissions, communicate with you about your membership, content updates, and community, send marketing communications where you have consented, improve Evolve and our website, and comply with our legal and tax obligations.
4. Legal Basis for Processing
- Contract: processing necessary to provide the membership you purchased.
- Consent: for marketing communications and non-essential cookies, which you may withdraw at any time.
- Legitimate interests: for improving Evolve and communicating with existing members about related offerings.
- Legal obligation: for tax, accounting, and regulatory requirements.
5. Sharing Your Data, Including with Paddle
We do not sell your personal data. We share it with:
- Paddle.com, our payment provider and Merchant of Record, who processes your payment, issues your receipt and tax invoice, and handles billing-related customer service. Paddle acts as an independent controller of the data it collects to process your transaction; its own privacy notice is available at paddle.com/legal/privacy .
- Service providers supporting our operations, such as our membership platform host, email marketing tools, and community software.
- Professional advisors, such as accountants or legal counsel, where necessary.
- Authorities, where required by law.
Where any service provider, including Paddle, transfers data outside the European Economic Area (EEA), appropriate safeguards such as Standard Contractual Clauses are used.
6. Data Retention
We retain your personal data only as long as necessary for the purposes described in this Policy, including to satisfy legal, accounting, or reporting obligations. Membership account and activity data is generally retained for the duration of your membership plus one month after cancellation, unless a longer period is required by law.
7. Your Rights
Under the GDPR, you have the right to access the personal data we hold about you, request correction of inaccurate data, request erasure (subject to certain exceptions), object to or restrict certain processing, request data portability, and withdraw consent at any time where processing is based on consent.

We take reasonable technical and organizational measures to protect your personal data against unauthorized access, loss, or misuse. No method of transmission over the internet is entirely secure, and we cannot guarantee absolute security.

Evolve is not directed at individuals under the age of 18, and we do not knowingly collect personal data from minors.

We may update this Privacy Policy from time to time. Changes will be posted here with a revised effective date. Continued use of Evolve after changes are posted constitutes acceptance of the updated Policy.

Return Policy
Effective Date: 01.01.2026
1. Your Statutory Right to Cancel (EU/EEA Consumers)
If you are a consumer purchasing Evolve from within the European Union or European Economic Area, you generally have the right to cancel your purchase within fourteen (14) calendar days of enrollment, without giving a reason, under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484/2013).
To exercise this right, notify us in writing within the 14-day period at info@lividevi.com.
Important: if you ask us to give you access to Evolve's digital content before the 14-day period ends, and we do so, you acknowledge that you lose this statutory cancellation right once you have accessed that content, to the extent permitted under the Regulations.
2. Our Refund Policy Beyond the Cooling-Off Period
Once the 14-day statutory cooling-off period has passed, or once you have accessed the Membership content within that period (see above), all sales are final. We do not issue refunds for:
- Change of mind after this point.
- Non-use of your Membership.
- Dissatisfaction with your personal results or progress.
- Failure to cancel a recurring subscription before it renews.
3. Cancelling a Recurring Membership
If you purchased Evolve as a recurring subscription, you can stop future billing at any time by logging into your account and selecting "Cancel Membership" or emailing us at info@lividevi.com. Cancelling stops future charges from your next billing date onward. It does not refund any billing period that has already been charged.
4. Billing Errors and Duplicate Charges
If you believe you were charged in error, such as a duplicate charge or a charge after you had already cancelled, please contact us immediately at info@lividevi.com. We will investigate genuine billing errors and correct them promptly.
5. How Refunds Are Issued
Where a refund is due, whether under the statutory cooling-off period or an error correction, it will be processed by Paddle.com, our Merchant of Record, back to your original payment method. Processing times may vary depending on your bank or card provider.
